In the Foxx case, the complainant claims the Oscar-winning actor, now 55, grabbed her by the “arm and pulled her to the back area of the rooftop” after meeting her at the bar.

US actor Jamie Foxx and Guns N’ Roses leader Axl Rose were both accused of sexual assault on Wednesday, as part of a slew of lawsuits filed in New York before the statue of limitations expired.

Sheila Kennedy, an actress and model, claims in her lawsuit against Rose that he “sexually assaulted her” in 1989 and that she “did not consent and felt overpowered”.

 

The accused victim in the Foxx case, identified only as Jane Doe, said that Foxx “intentionally and without consent used force to offensively touch” her, touching her breasts and genitals at a Manhattan rooftop club in 2015.

Both papers state that they are being filed under the New York Adult Survivors Act, a provision that allows for sexual assault lawsuits in situations that would otherwise be too old to litigate.

The 61-year-old lead singer of the hard rock band, known for songs like “Appetite for Destruction,” has yet to respond publicly.

He had attended the Las Vegas Formula One Grand Prix during the weekend, prior to the case being filed in a New York court.

The event is said to have occurred in a New York hotel room after the two met at a nightclub.

The legal case requires Rose, whose real name is William Bruce Rose, to face a jury trial and award Kennedy “punitive damages.”The complaint alleges that Rose forced anal sex on Kennedy. Kennedy’s lawyers claim that she “believed Rose would physically attack her, or worse, if she said no or attempted to push him away.”

“Rose used his fame, status, and power as a celebrity and performer in the music industry to gain access to manipulate, control and violently assault Kennedy,” according to the allegations.

Guns N’ Roses is well known for their singles “Welcome to the Jungle” and “Sweet Child O’ Mine.”

In the Foxx case, the complainant claims the Oscar-winning actor, now 55, grabbed her by the “arm and pulled her to the back area of the rooftop” after meeting her at the bar.

Once there, he allegedly began groping the plaintiff until a friend came seeking for her.

She also wants Foxx, whose actual name is Eric Marlon Bishop, to face a jury trial that might result in punitive damages.

According to the lawsuit, the complainant “will permanently be affected by the injuries and emotional distress she incurred as a result of the sexual assault, abuse, assault and battery.”

Foxx, who is also a comedian and a Grammy-winning musician, earned an Academy Award in 2005 for his role in the musical biopic “Ray.”
